Mondini Bonora Ginevra has assisted some condominiums in theprecautionary appeal of a condominium resolution which approved the start of renovation works amounting to over 33 million euros entirely financed with the CD mechanism Super bonus.
The Court of Milan, in collegiate composition at the time of the appeal, accepted the request for suspension with an innovative decision which recognised – in derogation from the special favourable legislation of Legislative Decree 34/2020 and regardless of the improvement in energy consumption – the need for unanimous approval for the replacement of the original materials of the facade (in this case, Klinker) with new materials of non-coinciding colour and characteristics, thus revealing an alteration of the architectural decorum.
