Whistleblowing, new rules for large companies

Legislative Decree No. 24 of 10 March 2023, which recently came into force, on the subject of whistleblowing, reinforces the awareness of companies on the subject, having the merit of significantly extending the scope of the mandatory application of the discipline. The legislation in question, in order to incentivise the whistleblowing system, on the one hand has organically defined the guarantees for ‘whistleblowers’ and on the other has broadened the range of violations that can be reported, leading companies to set up and update their whistleblowing systems. Despite the innovative scope of the work, there is no shortage of issues relating to organisational aspects of whistleblowing management and new risks for companies related to an inadequate whistleblowing system.
