Mondini Bonora Ginevra wins before the Unified Patent Court (Milan section)

On the subject of centering devices for forming tools in the mold making and die casting sector, Carlo Ginevra And Andrea Marchetti have successfully assisted Intercom Srl, sued by Agathon AG together with the German distributor Knarr Vertriebs GmbH before the’UPC (Milan section), obtaining the complete rejection of all the opposing party's requests for infringement, injunction, withdrawal from the market of the allegedly infringing products and compensation for damages, as well as the cancellation of the European patent EP 2 363 263 of Agathon AG in the form originally granted.

We are proud to have represented our client in this matter—with the invaluable assistance of Andrea Mittler, Engineer, on the technical side—and to have achieved this result, which confirms the importance of a rigorous approach, both technically and legally, in UPC litigation, where patent validity and infringement require careful consideration. UPC litigation represents a particularly demanding challenge for small and medium-sized Italian businesses, which can be faced head-on—and overcome—with determination, teamwork, and the right combination of specialized legal and technical expertise.
