The Unified Patent Court (Milan section) has ruled on European patent EP 2 363 263

In the dispute between the patent holder Agathon, the Italian manufacturer Intercom and the German distributor Knarr, the Unified Patent Court (Milan section) has ruled on the European patent EP 2 363 263, relating to centering devices for forming tools in the mold making and die casting industry, declaring the patent is null and void in the form originally granted and maintaining it in force only in a limited form, as well as rejecting in its entirety the infringement claim brought against the defendant companies (*).

This result confirms the importance of a rigorous approach, both technically and legally, in litigation before the UPC, where patent validity and infringement require careful consideration.

We are proud to have assisted our client in this matter. Litigation before the UPC represents a particularly daunting challenge for small and medium-sized Italian businesses, but it is a challenge that can be faced head-on—and overcome—with determination, teamwork, and the right combination of high-level legal and technical expertise.

A heartfelt thank you to everyone who contributed to achieving this result.

*The decision was made at first instance and is subject to appeal.
