Mondini Bonora Ginevra assisted some condominiums in the precautionary appeal of a condominium resolution which approved the start of renovation works for an amount of over 33 million euros entirely financed with the mechanism c.d. Superbonus.
The Court of Milan, in collegial composition at the time of the complaint, accepted the request for suspension with an innovative decision which recognized – in derogation from the special legislation in favor of the legislative decree 34/2020 and regardless of the improvement in energy consumption – the need for unanimous approval for the replacement of the original materials of the facade (in this case, Klinker) with new materials of non-coinciding color and characteristics, noting in this an alteration of the architectural decor.
