Liability of entities under Legislative Decree 231/2001

The firm offers advice and assistance on the legal aspects related to the design, implementation and maintenance of organisational models pursuant to Legislative Decree 231/2001, up to assistance to the Supervisory Board or direct assumption of the role of SB and training activities, and in particular:

  • analysis and mapping of company processes ‘at risk’ of offences (risk assessment);
  • evaluation of the existing control system;
  • assisting in the preparation and updating of procedures and operational protocols to protect corporate processes at risk of offences being committed;
  • assistance in drafting, implementing and updating the organisational model pursuant to Legislative Decree 231/2001, as well as in defining an internal disciplinary and sanctions system;
  • assistance in drafting and updating the Code of Ethics and the Code of Conduct and/or Behaviour;
  • assistance in drafting, implementing and updating the whistleblowing procedure/policy;
  • consultancy and assistance in defining and implementing the system of company proxies and powers of attorney, also with regard to the protection of health and safety in the workplace in compliance with the requirements of Legislative Decree 81/2008;
  • consultancy and assistance in drafting minutes and reports for top management;
  • training on the liability of entities pursuant to Legislative Decree 231/01
  • membership of the Supervisory Board envisaged by Legislative Decree 231/01, both single and collective.
